Kelantan losing out from ambiguities in Petroleum Act

Oil and gas expert Anas Alam Faizli said ambiguities in the Petroleum Development Act of 1974 (PDA) must be sorted out, as different parties were interpreting it differently.

Speaking to FMT, Anas said, “There are now a host of different interpretations and ambiguities in relation to what documents can be applied to resolve the issue which is the main cause of concern. If this is not addressed there will be no end to this.

Anas said this in regard to Kelantan’s oil royalty dispute in which one party claimed there was no need for royalty payments to Kelantan.

Explaining it in greater detail, Anas said, ”Others may argue, that the Assignment Deed, and the Vesting Grant 1975/1976 supersedes the law, which then conflicts with views by other experts who may interpret it differently based on their perspective of the Federal Constitution or the Petroleum Act.”


Mustapa challenges Kelantan govt to show proof for oil royalty claim

Kelantan Barisan Nasional (BN) chairman Datuk Seri Mustapa Mohamed today challenged the PAS-led state government to show proof for the oil royalty claim bandied about by the party.

“The state government claimed that the Federal Government had denied their right to receive the oil royalty. This is a big lie. They have no right.

“We challenge them to show proof that the Federal Government must pay RM12 billion in oil royalties to Kelantan,” he said during a political talk in Tebing here, tonight.


Let Sabah have all 10% oil royalty – UPKO

United Pasokmomogun Kadazandusun Murut Organisation (UPKO) yesterday urged the Federal Government, which is receiving a five per cent share of the oil royalty from Petronas, to instead give it to the oil producing states.

“We in Upko have been saying all along, there is an urgent need for Sabah, being an oil producing state, to be given more than the five per cent share it is getting at the moment. I wish to reiterate our party congress resolutions for several years now, that the most practical solution is for Putrajaya to give its share to Sabah. This is doable,” said Upko acting president Datuk Madius Tangau.

 


New O&G group aims to help Sabah firms get bigger slice of industry pie

A newly-formed group is aiming to provide oil-and-gas sector suppliers in Sabah with the needed skills and contacts to tap into the industry that offers tens of billions of ringgit in jobs.

Calling itself the Sabah Oil and Gas Services Council (SOGSC), it says it will aggressively conduct technical programmes in collaboration with key industry players such as Petronas to enable members to gain the expertise to service such companies.

“The potential for Sabah’s oil and gas industry is extremely high, and we need to leverage this to better benefit Sabahan service providers.

“Currently they are not well-equipped with the right skills and knowledge to support the industry and jobs are going out to foreign companies from West Malaysia and elsewhere,” said SOGSC secretary Willie Ng during a press conference here today.

George Kent (Malaysia) Bhd, which is tendering for RM15 billion worth of jobs including those for the mass rapid transit (MRT) line 2 project, is looking to diversify its presence into the oil and gas sector.

Speaking to reporters after the company’s AGM and EGM here yesterday, its chairman Tan Sri Tan Kay Hock  said it is still studying the proposal to tap into the oil and gas industry, but will start with the service engineering segment.

“We want to go into the oil and gas sector, but with the right space and target,” he stressed, declining to elaborate further.

Tan explained however that the oil and gas sector is not a new venture for the group considering that it used to have supply services to petrol pumps around the country.

A veteran newsman has cautioned Putrajaya against interfering with Petronas following the oil major’s success in moving up the ranks of the Fortune 500 list.

Datuk A. Kadir Jasin (pic), the former New Straits Times group editor-in-chief, said he hoped that Petronas, which ranked 69 on the list, would continue to be successful without any interference from the government.

“Our hope is that Petronas will continue to be successful without damaging interference from the government while dividends paid out to Putrajaya (RM27 billion last year) would be put to good use without wastage and leakages,” he wrote in his blog today.

While politicians have long interfered with the state-owned oil company’s operations, it appears that current CEO Tan Sri Shamsul Abbas is apparently coming under pressure to step down and elements of Malaysia’s ruling party are trying to remove him.

 


2,000 people now live in fear – Baru Bian wants Petronas to explain Lawas explosion

Sarawak PKR chief has demanded Petronas conduct “a full and thorough” investigation into the cause of the explosion of its gas pipeline in Lawas earlier today and make their findings public to placate the fears of people living along the pipeline.

Baru Bian said some 2,000 people living along, or close to, the pipeline in the most northern district of the state are now living in fear as the assurance the national petroleum company gave them before they constructed the pipeline years ago is now all very hollow.

“Is this pipeline safe. To me, it is unsafe. To them, it is very unsafe following what happened today.


Sarawak’s oil royalty poser

SARAWAK Chief Minister Tan Sri Adenan Satem, just 100-odd days in office, has made a demand for an increase in oil royalty to the state from 5% to 20% a key agenda of his administration.

Last month, the state assembly passed a resolution to this effect and Adenan repeated it last week, in the presence of Prime Minister Datuk Seri Najib Razak in Miri.

Najib said the federal government would consider the matter.

Those who are familiar with how the formula of royalty payment to the oil producing states of Sabah, Sarawak and Terengganu works are astounded by the demand, especially asking for a 15% increase, which is ridiculously high.

It calls into question whether the Sarawak state government understands the formula, which I must add here, is rarely explained to the public by Petronas.

Hence public ignorance of the oil royalty issue.


Flesh out pledged Sarawak oil royalty hike, Putrajaya told

Putrajaya must set a deadline to discuss revising royalty payment for oil-producing states to demonstrate the sincerity of the prime minister’s pledge to consider increasing the quantum, Sarawak PKR vice-chairman See Chee How said today.

See told a press conference at the state PKR headquarters here that verbal assurance alone was not enough, and that such an increase must not come in the form of development grants as these were already the federal government’s obligation.
