Act to regulate oil industry in Sabah

Chief Minister Datuk Seri Mohd Shafie Apdal will announce an enactment on mineral resources that will allow the state government to regulate the oil industry over its land and water in the future.

Shafie said this at the State Assembly in response to another additional question posed by Datuk Dr Jeffrey Kitingan on whether the state government would emulate Sarawak and activate the mining and land ordinance laws to regulate the Sabah oil industry.

“Indeed, that is always in our thoughts. Soon I will have an enactment associated with minerals, but we are looking at two sectors. Whether it will be in the power over land, if it is in the field of land (it will cover) only mainland and where the offshore, you cannot do anything.

“But if it covers up the whole thing that is related to the ordinance of available mineral resources, I am confident that this will further empower the state government. I hope that YB Tambunan can provide support when I present this ordinance,” he quipped.

Shafie will also lead the pursuit of Sabah’s 40% oil net revenue owed by the federal government to the state as stated in the Malaysia Agreement 1963 (MA63) and Schedule 10, Article 112 of the Federal Constitution.

Sabah expects RM5 bil in petroleum royalty

 The Sabah government expects no less than RM5 billion annually if petroleum royalty is increased from 5% to 20%.

However, Chief Minister Mohd Shafie Apdal said Petronas had informed the state government that cash payments from oil and gas revenues would depend on various factors.

“Among the factors which determine the amount of royalty include the mechanism and basis for the increments in cash payments which need to be discussed and decided by the relevant parties, estimates of oil and gas output, advanced plans for the development of oil and gas fields and global crude oil prices,” he said.

Shafie, who is also the state finance minister, said this in reply to a question from Dr Joachim Gunsalam (PBS-Kundasang) at the Sabah state assembly here today.

Trans Sabah Gas Pipeline: Get our money’s worth, says MP

A Sabah MP has urged the government to renegotiate the terms for the Trans Sabah Gas Pipeline (TSGP) with China.

Kota Kinabalu MP Chan Foong Hin also wanted the authorities to continue probing the multi-billion ringgit project to determine if there were any suspicious dealings or connections.

“Renegotiate the terms with China, the project developer, as we have paid about 85% of the money but the real work done has only been 13%… we can’t just waste the money with nothing to show.

Set deadline for getting 20% oil royalty, says Kitingan

Opposition Sabah politician Jefferey Kitingan has proposed two dates by which the Pakatan Harapan federal government may honour its manifesto promise of a 20% oil royalty payment to Sabah and other oil-producing states.

Kitingan, president of the local STAR party, suggested Sept 1 or Jan 1 as the date by which oil royalty should be paid, and urged Parti Warisan Sabah, allies of Pakatan Harapan, to push for a firm date.

However, an activist for states’ rights has questioned whether the federal government would pay royalties or a share of the profits earned by national oil company Petronas.

Deliver 20% oil royalty first, Pakatan urged

The federal government has been urged to deliver on an election campaign promise of granting a 20% oil royalty to Sabah and Sarawak, even as the national petroleum company, Petronas, insists that it has legal rights to oil and gas resources in the whole country.

Johan Ariffin, a former deputy director of Sabah Foundation, said the issue of the ownership would take time to resolve.

However, the Pakatan Harapan campaign promise of 20% oil royalty could be carried out “without much difficulty and should be done first” before the dispute over ownership was resolved, he said.

Sabah pipeline row: Get your facts right, says Ongkili

A former federal energy minister, Maximus Ongkili, has criticised Sabah DAP for making wild accusations about the Trans Sabah Gas Pipeline project recently highlighted for allegedly dubious financial transactions.

Ongkili hit out at state DAP secretary Chan Foong Hin for making comments on the issue without having enough facts to support his statement.

“Get your facts right first (and) do justice to your MP job,” he said. Chan is the MP for Kota Kinabalu.

“Obviously he does not know about the Kimanis-Sandakan pipeline project,” said Ongkili, accusing Chan of political immaturity and DAP leaders of being “political novices in government”.

Musa wants state AG to intervene in Petronas’ oil claim

Sabah Barisan Nasional chairman Musa Aman says he will instruct the state attorney-general to make an application for the state government to intervene in Petronas’ legal bid to claim ownership over the country’s petroleum resources.

Musa, who signed off as the chief minister, said in a statement that this was to safeguard Sabah’s oil and mineral resources.

“We will deploy all available resources of the state government to ensure that the best interest of Sabah is defended always,” he said.

Petronas is seeking a Federal Court declaration that, among others, that based on the Petroleum Development Act, 1974, it effectively has the exclusive authority over all petroleum activities in Malaysia.

Sabah will pursue 20% oil royalty demand, assures Shafie

Sabah Chief Minister Shafie Apdal has maintained that the state will work on its demand for 20% oil royalty from the federal government in line with his party’s manifesto for the recent general election.

“What we’ve spelled out in the manifesto, our 20% oil royalty, we’ll pursue it,” the Parti Warisan Sabah president said on the sidelines of an event here today.

Shafie had said on April 27, while launching the party’s 13-point manifesto, that Warisan would ensure the oil royalty due to the state increased from the current 5% to at least 20% if it won the state in the polls.

HAS the PH government broken its promises to the people of Sarawak and Sabah vis-à-vis its Pakatan Harapan Book (Buku Harapan), outlining the four-party coalition’s election manifesto?

As events unfolded with the first bombshell dropped on Sarawak on Monday by Petronas in a suit, seeking legal redress to its oil and gas rights in the state, let us take a look specifically on petroleum rights.

First, let it be known that Petroleum Development Act 1974 (PDA 1974) empowers the Prime Minister to make regulations for the purpose of putting into effect the provisions of PDA 1974 in the conduct or the carrying on of any business or services relating to the explorations, exploitations, winning or obtaining of petroleum.
