Sarawak to introduce licencing requirement for gas distribution in January

Sarawak is imposing a condition requiring any gas distribution activities carried out in the state could only be done with a licence issued by the state’s Ministry of Utilities.

The ministry said this requirement would take effect from Jan 1 next year when the regulations under the Distribution of Gas Ordinance 2016 came into full force.

“Applicants should note that they are required to have a valid licence issued under the ordinance to carry out the gas distribution activities in Sarawak even though they may have permits or licences by any other government agencies,” it said in a statement today.

The chief minister’s office today said the purchase of stakes in Petronas is not among the issues discussed by the steering committee on Malaysia Agreement 1963 (MA63).

It said details concerning oil and gas are only deliberated in special discussions between the prime minister and the Sarawak and Sabah chief ministers.

The office rubbished a claim by Sarawak DAP chairman Chong Chieng Jen that Chief Minister Abang Johari Openg had agreed in principle to purchase a stake in Petronas during an MA63 steering committee meeting.


‘Sarawak can demand from Petronas’

Sarawak has contributed immensely to the success of Petroliam National Bhd (Petronas) over the years and thus, it is only fair for the national petroleum corporation to pay the state-imposed 5% sales tax.

In pointing this out, Assistant Minister in Chief Minister’s Department (Law, State-Federal Relations and Project Monitoring) Datuk Sharifah Hasidah Sayeed Aman Ghazali (pix) views Petronas’ reluctance in paying the tax – amounting to RM1.2 billion for the period between January and June this year – as the reason why the state government filing a suit against the company on Nov 21 this year.

“From the statistics, it’s very clear we, Sarawak, contribute hugely to the success of Petronas and therefore, I think all of us agree that the time has come for us to get a little bit of that back to the state – if not more,” she spoke during a public talk on ‘Talking About What Really Matters’, which took place at the Chemsain auditorium along Jalan Rock here on Friday night.


Sarawak CM declines Dr M’s offer to buy stake in Petronas

The state government does not intend to buy a stake in Petroliam Nasional Berhad (Petronas), Chief Minister Datuk Patinggi Abang Johari said today, in response to a recent offer by Prime Minister Tun Dr Mahathir Mohamad to sell stakes in the company to Sarawak and Sabah.

“What is the point for us to buy the stakes?” he asked at the launch of a Blueprint for development programme here this evening.

He said it will be pointless for Sarawak to buy stakes even if Petronas were to give two or three per cent as the state government will not have a say in how Petronas should be managed.

The Sarawak government will not consider buying stakes in Petroliam Nasional Berhad’s (Petronas) assets in the state’s territorial waters, Law, State-Relations and Projects Monitoring Assistant Minister Datuk Sharifah Hasidah Sayeed Aman Ghazali said last night.

She said there is nothing to be happy about with the offer mentioned by Prime Minister Tun Dr Mahathir Mohamad that the federal government intended to sell stakes in Petronas to Sarawak and Sabah.

Anger is building up again in the East Malaysian states with Dr Mahathir Mohamad’s statement this week on the oil royalties.

Somehow we get the feeling that we have been led up the garden path by the Pakatan Harapan (PH) government.

Mahathir is now changing his stance and seems to have run out of ideas on how to deal with this sticky issue. His incoherent response to the oil royalties issue is sowing more confusion, creating a wider rift between the federal and state governments.

Mahathir in a Reuters interview said the government is considering selling stakes in Petronas to states where the company’s oil and gas fields are located. It seems odd that the oil-producing states like Sabah and Sarawak are now offered stakes in Petronas to help a debt ridden federal government.

Malaysia is considering selling stakes in energy giant Petronas to two of its 13 states where the company’s oil and gas fields are, Prime Minister Mahathir Mohamad told Reuters, in a bid to raise funds for the debt-laden government.

Such a move may also give states such as Sarawak and Sabah a say in the running of Petronas, the world’s third-largest exporter of liquefied natural gas.

Tun Dr Mahathir said on Tuesday in an interview that the government could not meet a demand made by the states for a quadrupling of the royalties paid by the government-owned company to 20 per cent of its profit.


Legality of Sarawak’s petroleum sales tax hinges on MA63

THE court will decide the legitimacy of the imposition of the sales tax by Sarawak on petroleum products based on the Constitution and what is provided under the agreement when the East Malaysia state joined Malaysia 56 years ago.

The state, which is rich with petroleum resources, imposed a 5% sales tax on petroleum products – crude oil, natural gas, liquefied natural gas, chemical-based fertilisers and gas-to-liquid products — sourced from the state early this year.

Petroliam Nasional Bhd (Petronas) has not paid the additional sales taxes for its oil and gas (O&G) exploration activities in the state.


Petronas confirms Sarawak’s lawsuit against it

Petroliam Nasional Bhd (Petronas) today confirmed that the Sarawak government and the comptroller of state sales tax have filed a lawsuit against it over the alleged failure to pay sales tax to the state.

“Petronas confirms that the comptroller of state sales tax of Sarawak and the Sarawak state government have filed an action against Petronas before the High Court of Kuching on Nov 21, 2019, for non-payment of the Sarawak sales tax on petroleum products,” the national oil company said in a statement.


Malaysian state takes court action against Petronas to recoup tax – Bernama

Malaysia’s state of Sarawak filed a writ summons and statement of claim against national energy firm Petroliam Nasional Bhd on Thursday to recover taxes owed, according to media reports.

National news agency Bernama reported that the company, better known as Petronas, was said to be the only oil and gas company operating in the state that had not paid the 5% state sales tax imposed at the start of this year.
